Family violence against children and adolescents in Mexico: coexistence of models and control of constitutionality.

Resumen:

A partir de la ratificación de la Convención sobre los Derechos del Niño, el marco jurídico en México ha experimentado varias reformas. Esta evolución se ha traducido en dos reformas constitucionales y la aprobación de dos leyes específicas en la materia. La legislación civil, si bien ha sido modificada, contrasta con las normas constitucionales y las leyes especiales, generando problemáticas diversas en materia familiar. A través de la jurisprudencia, el Poder Judicial Federal ha establecido criterios que armonizan la legislación familiar con la Constitución mexicana. El objetivo del trabajo es analizar el control de constitucionalidad en materia de violencia familiar hacia niñas, niños y adolescentes, en particular en materia de prohibición de castigo corporal y humillante.

Abstract:

Since the ratification of the Convention on the Rights of the Child, the legal framework in Mexico has undergone several improvements. This evolution has resulted in two constitutional reforms and the approval of two specific laws on the matter. Although it has been modified, civil legislation contrasts with constitutional norms and special laws, generating various issues in family matters. Mexican Federal Judiciary has established criteria that harmonize family legislation with the Mexican Constitution through jurisprudence. The objective of this work is to analyze the control of constitutionality in matters of family violence towards children and adolescents, particularly in terms of the prohibition of physical and humiliating punishment.
