Resumen:
La pandemia da “SarS-Cov-2” prima e la successiva crisi energetica - anche a seguito di eventi bellici - con il conseguente aumento esponenziale dei costi delle materie prime, ha stravolto le vicende giuridiche inerenti agli ordinari rapporti negoziali. Innanzi a tale scenario, tanto gli interpreti che le Corti hanno progressivamente preso coscienza della biasimevole inadeguatezza dello strumentario a disposizione degli operatori del diritto italiani e stranieri. Il contributo osserva e analizza gli istituti di rinegoziazione del diritto internazionale e di alcune significative esperienze giuridiche al fine di fornire efficaci soluzioni de iure condendo.
Abstract:
The “SarS-Cov-2” pandemic and the subsequent energy crisis - also following war events - with the consequent exponential increase in the costs of raw materials, has upset the legal events inherent in ordinary negotiation relations. Faced with this scenario, both the interpreters and the Courts have progressively become aware of the blameworthy inadequacy of the tools available to Italian and foreign legal practitioners. The paper observes and analyses the institutes for the renegotiation of international law and some significant legal experiences in order to provide effective solutions de iure condendo.
