Sharing economy and property rights: from ownership to new forms of time- sharing.

Resumen:
La multipropiedad, en sus varias facetas, se difunde rápidamente como instituto que logra maximizar la productividad de la res, componiendo el interés empresarial con el interés del usuario en una gestión eficiente y racional de los bienes inmuebles. Analizada la complejidad del fenómeno y el rol central que la autonomía negocial tiene en este contexto, el ensayo se enfoca en la contribución sistemática de la multipropiedad a la re- conceptualización de la relación entre res y propiedad en la economía del intercambio. Siguiendo la trayectoria evolutiva más reciente, el análisis se concentra en las potencialidades de las nuevas tecnologías, investigando el posible rol que sistemas de registro distribuido y token pueden jugar en la circulación inmobiliaria y en la difusión de nuevas formas de goce en tiempo compartido.
Abstract:
Time-sharing, in its various models, rapidly spreads as a tool that manages to maximize the productivity of goods, combining both the entrepreneurial interest and the user’s interest in an efficient and rational management of real estate wealth. After analyzing the complexity of the phenomenon and the central role played in this context by private autonomy, the essay focuses on the systematic contribution of time-sharing in the reconceptualization of the relationship between res and ownership in the sharing economy. Following the most recent evolutionary trajectory, the analysis moves to the potential of new technologies, investigating the possible role that distributed ledger technologies and tokens can play in real estate circulation and in the diffusion of new forms of time-sharing.
