Resumen:
El nuevo Reglamento Europeo sobre ensayos clínicos ha venido a crear los ensayos de bajo nivel de intervención. Se trata de una modalidad específica que ayudará a los centros de investigación de menor tamaño a realizar actividades propias, a un menor coste y con unos trámites burocráticos más cómodos. Dentro de estos ensayos, la figura del investigador se erige en central, como coordinador de la labor de investigación; siendo, por tanto, el objetivo principal en una eventual reclamación de responsabilidad legal por daños causados a participantes. Tras ofrecer un análisis general tanto de la nueva modalidad de ensayos como de los sujetos intervinientes en un ensayo clínico, analizaremos la responsabilidad del investigador en esta nueva modalidad de innovación.
Abstract:
The new European Regulation on clinical trials has created, what are called low-intervention clinical trials. This is a specific type of experimentation that may help small research centers to perform their own activities at a lower cost and with a more comfortable bureaucracy. Within these trials, a leading figure stands at the center: the investigator, as coordinator of the research; being, therefore, the main objective in a prospective action for damages and liability from the participants in the research. After a general analysis of both the new kind of trials and the subjects involved in these, we will discuss the liability of the investigator in this new form of innovation.
