Resumen:

El objetivo de este trabajo se centra en el análisis de las modificaciones introducidas en el Código Civil por la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, en materia de ejercicio de la facultad de testamentifacción. En este estudio se analizan particularmente las condiciones para otorgar testamento por la persona con discapacidad, así como los límites a su libertad de testar en favor de curadores y cuidadores.

Abstract:

The aim of this paper focuses on the analysis of the modifications introduced in the Civil Code by Law 8/2021, June 2nd., which reforms the civil and procedural legislation for the support of people with disabilities in the exercise of their legal capacity, in matters related with the ability of granting will. This study particularly analyzes the conditions that are required of people with disabilities to grant a will, as well as the limits to their freedom to do so in favour of guardians and caregivers.
