Disciplinary regime in the stock market law

Resumen:

Según la legislación vigente, tendrán la consideración de infracciones, por acción o por omisión, las conductas o comportamientos derivados del incumplimiento de determinados requisitos, conductas o imposiciones tales como la de reserva de actividad y/o de la obligación de obtener autorizaciones exigidas, entre otras. Más concretamente, el régimen jurídico de las infracciones y sanciones viene recogido en el Título VIII del RD Lg. 4/2015, de 23 de octubre, que aprueba el TR la Ley del Mercado de Valores (en adelante LMV 15), bajo la rúbrica del Régimen de supervisión, inspección y sanción. El presente trabajo tiene como objeto el estudio del sistema que así se configura en materia disciplinaria y sus consecuencias y alcance; asimismo con la adaptación a la nueva ley de procedimiento y con el fomento del reconocimiento expreso a la Comisión Nacional del Mercado de Valores (CNMV) de su competencia en la materia.

Abstract:

In the current laws and under the influence and the European adaptation, will be considered infractions, by action or by omission, the behaviors or conducts derived from the nonconformity conducts or behaviors derived from the breach of certain requirements, behaviors or impositions such as the reservation of activity and / or the obligation to obtain required authorizations, among others. More specifically, the legal regime of infringements and sanctions in the new legislation is set out in the RD Leg. 4/2015, of October 23, approving the Consolidated Text of the Market Law of Values (hereinafter LMV 15), and which is included in its Title VIII, under the heading of the Supervision, Inspection and Sanction Regime, proceeding in the following lines to the study of the system that is configured in disciplinary matters and the consequences And scope of it all; Also with the adaptation to the new procedural law and with the promotion of the express recognition to the CMNV of its competence in the matter.
