Resumen:

Il contributo è dedicato al divieto di patto commissorio e, in particolare, all’apporto che Cesare Massimo Bianca ha dato al suo studio. Individuatane la ratio nell’interesse generale alla repressione di queste pattuizioni, in senso concorde con le tesi di Bianca, si passa poi a descrivere la portata e gli effetti del divieto, sempre nel dialogo con gli studi dell’autore.

Abstract:

The paper is dedicated to the prohibition of patto commissorio and, in particular, to Cesare Massimo Bianca’s contribution to its study. Having identified the rationale in the general interest in the repression of such agreements, in accordance with Bianca’s thesis, the essay then describes the scope and effects of the prohibition, always in dialogue with the author’s studies.
