What is and what is the interest of the minor?

Resumen:

En el presente artículo se analiza el origen del concepto del interés superior del menor y cómo se incorporó en el ordenamiento jurídico español, a partir de su triple dimensión. En una segunda parte se determina para qué sirve el interés superior del menor en el derecho español, desde el ámbito normativo hasta su aplicación en los tribunales.

Abstract:

This article analyzes the origin of the concept of the best interests of the minor and how it was incorporated into the Spanish legal system, from its triple dimension. In a second part, it is determined what the best interest of the minor is in Spanish law, from the regulatory sphere to its application in court.
