Prime riflessioni sul parto anonimo nell’ordinamento giuridico italiano

First reflections about anonymous childbirth in the Italian legal system.

Resumen:

L’obiettivo del lavoro è quello di analizzare la questione del parto anonimo, un tema che ha sempre generato un acceso dibattito, essendo più volte evidenziato in Italia, sia dalla Corte Costituzionale che dalla Suprema Corte di Cassazione, la necessità di un equilibrio tra i diritti delle parti interessate: da un lato il diritto del bambino di accedere alle informazioni sull’identità e l’origine dei suoi genitori biologici, e dall’altro il diritto all’anonimato e alla riservatezza della donna che partorisce suo figlio, che ha trovato tale protezione, al punto da limitare il diritto opposto della minore a conoscere la propria identità. Verrà inoltre dato uno sguardo alla dottrina e alla giurisprudenza più recenti in materia.

Abstract:

This paper aims to analyze the issue of anonymous childbirth, an issue that has always generated a strong debate, being pointed out several times in Italy, both by the Constitutional Court and by the Supreme Court of Cassation, the need for balance between the rights of stakeholders: on the one hand, a) the right of the child to access information on the identity and origins of his biological parents, and on the other hand b) the right to anonymity and confidentiality of the woman who gives birth to her son, who has found such protection, to the point of limiting the opposing right of the child to know her identity. A look at the most recent doctrine and jurisprudence on the subject will also be given.
