Resumen:

En este trabajo se analizarán dos cuestiones recientemente tratadas por el Tribunal Supremo en su sentencia de 20 de noviembre de 2017 (RJ 2017, 5099), sobre los pactos alimenticios realizados entre cónyuges. En concreto, se analizará, por un lado, la naturaleza jurídica de tales pactos, y por otro lado y en función de la misma, se estudiará la posibilidad de extinguir el derecho de alimentos pactado voluntariamente por el desistimiento unilateral del obligado a prestarlos. Partiendo de la resolución citada se pretende, como objetivo principal, esclarecer los criterios seguidos por los tribunales en éste y otros casos conexos, aportando consideraciones críticas sobre su actuación y proponiendo soluciones alternativas.

Abstract:

This paper focuses on two questions analysed by the recent sentence from the Spanish Supreme Court, November 20th, 2017 (RJ 2017, 5099), related with the maintenance agreements between spouses. In particular, we will analyse, on the one hand, their legal nature, and on the other hand, the possibility of their termination by unilateral withdrawal. Following this resolution, we will pretend, as a main objective, to clarify the criteria followed by the courts in this case and other related cases, providing critical considerations on their actions and proposing alternative solutions.
