New Technologies and the rights of older adults in the healthcare field.

Resumen:
La utilización de las nuevas tecnologías en el ámbito sanitario puede reportar numerosas ventajas, pero también puede generar situaciones de desigualdad y discriminación en diferentes colectivos especialmente vulnerables, como el de las personas mayores, circunstancia que conduce a la necesidad de adoptar las medidas necesarias para proteger debidamente sus derechos en relación con la salud. Al mismo tiempo, debe garantizarse la autonomía de las personas mayores para tomar decisiones respecto a su propia salud mediante el ejercicio de su derecho a consentir u oponerse a determinados tratamientos, capacidad de elegir que también se extiende a cómo deben utilizarse las nuevas tecnologías.
A su vez, el derecho de las personas mayores a decidir sobre la propia salud nos conduce al documento de voluntades anticipadas, instrumento que les permite garantizar en el futuro el cumplimiento de sus deseos en relación con su salud ante determinadas circunstancias que les impidan expresar su voluntad. A estos efectos, la intervención notarial puede resultar decisiva para garantizar el respeto absoluto a la voluntad del paciente mayor de edad.
Abstract:
The use of new technologies in the healthcare field can offer numerous advantages, but it can also create situations of inequality and discrimination for various especially vulnerable groups, such as the elderly. This circumstance underscores the need to adopt measures to adequately protect their rights concerning health. At the same time, it is essential to ensure the autonomy of older individuals to make decisions about their own health by exercising their right to consent to or refuse certain treatments—a capacity for choice that also extends to how new technologies should be utilized.
Furthermore, the right of older people to decide about their own health leads us to the advance directives document, an instrument that allows them to ensure their wishes regarding health are respected in the future in circumstances where they may be unable to express their will. In this regard, notarial intervention can play a decisive role in guaranteeing absolute respect for the will of the adult patient.
