Surrogacy, the reasons for the ban and proposals for regulation: a circle that doesn't close

Resumen:

Il contributo affronta il tema della maternità surrogata interrogandosi sulle ragioni del divieto della stessa. In questa prospettiva, la riflessione si sofferma sulla esigenza di tutelare la autodeterminazione della donna e sul “rimedio” rappresentato, de iure condendo, dalla ammissibilità della surrogazione effettuata a titolo gratuito, mettendo in luce limiti e contraddizioni dell’impostazione. Un cenno è infine dedicato al problema della tutela dei soggetti nati da tale pratica.

Abstract:

This article addresses the issue of surrogacy by questioning the reason for its prohibition. In this perspective, the analysis focuses on the need to protect the self-determination of women and on the “remedy”, de iure condendo, to allow the non-commercial surrogacy, highlighting the limits and contradictions of the approach. Finally, a mention is dedicated to the problem of the protection of children born from this practice.
