Resumen:
La STS 15 julio 2016 ha sentado doctrina jurisprudencial con relación a los llamados reconocimientos de complacencia mediante argumentos claros y ordenados, aunque no por ello incontrovertibles. Esta doctrina se ha visto reafirmada por la posterior STS 28 noviembre 2016. Como consecuencia de ello, las Audiencias Provinciales han resuelto los casos que han conocido conforme a este fallo. Sin embargo, la doctrina especializada se ha manifestado, desde diferentes perspectivas, con relación a tres ejes cruciales que resuelve el fallo en esta materia: el primero, la defensa de la validez del reconocimiento de complacencia; el segundo la ratificación de la legitimación del autor de este reconocimiento para entablar la acción de impugnación de la paternidad fundada en el hecho de no ser el padre del reconocido; finalmente, sobre la acción de impugnación que procede cuando el reconocedor contrae matrimonio con la madre del reconocido, recordando la diferencia que se presenta en los términos de caducidad, en consideración a la clase de filiación: matrimonial o no matrimonial.
Abstract:
SSC 15 July 2016 has established jurisprudential doctrine in relation to the so- called recognitions of complacency by means of clear and orderly arguments, although not for this reason indisputable. This doctrine has been reaffirmed by the subsequent SSC 713/2016, of November 28. As a result, the Provincial Courts have resolved the cases they have known in accordance with this ruling. However, the specialized doctrine has manifested from different perspectives, in relation to three crucial axes that the ruling resolves in this matter: the first, the defense of the validity of the recognition of complacency; the second, the ratification of the legitimacy of the author of this recognition to file the action to challenge the paternity based on the fact of not being the father of the acknowledged; finally, on the action of challenge that follows when the acknowledger marries the mother of the acknowledged, recalling the difference that arises in the terms of expiration regarding the type of filiation: marital or nonmarital.
