Los derechos reales y la publicidad registral como alternativas de tutela ante la deficiente protección a las uniones de hecho en el contexto jurídico cubano

Resumen:

En el presente artículo se analiza la posibilidad de utilizar los derechos reales y la publicidad registral inmobiliaria como una alternativa que permita lograr un equilibrio entre el derecho de los convivientes, el derecho del propietario y el derecho del tercero adquirente de un inmueble a título oneroso, que tribute a la seguridad jurídica dinámica de los derechos reales. Además, de hacerse un estudio de la protección que reciben las uniones de hecho en el contexto jurídico cubano y la viabilidad de que sean tutelados sus miembros como un tipo particular de convivientes.

Abstract:

This article discusses the possibility of using real rights and real estate registration advertising as an alternative that allows to achieve a balance between the right of cohabiting, the right of the owner and the right of the third party acquiring the property through a sale that contributes to the dynamic legal security of real rights. In addition, a study of the protection that facto unions receive in the Cuban legal context and the viability of their members is being protected as a particular type of cohabitation.
