The Inalienable Succession Rights and Legitimate Rights of the Separated Widowed Spouse in the Spanish Civil Code and in the Compilation of the Civil Law of the Balearic Islands

Resumen:
Los derechos sucesorios del cónyuge viudo no son uniformes en todo el territorio español, ni siquiera en algunas Comunidades Autónomas como en las Islas Baleares. El cónyuge viudo no tiene derechos legitimarios en Ibiza/Formentera. En el Código Civil, estos derechos vienen condicionados por la separación judicial o por la separación de hecho del matrimonio. En Mallorca/Menorca, estos derechos no sólo vienen condicionados por la separación judicial o por la separación de hecho del matrimonio, también puede ser determinante saber quién es el culpable de la separación.
Abstract:
The succession rights of the widowed spouse are not uniform throughout Spain, not even in some autonomous communities such as the Balearic Islands. The widowed spouse does not have inalienable succession rights in Ibiza/Formentera. In the Civil Code, these rights are conditioned by legal separation or separation in fact of marriage. In Mallorca/Menorca, these rights are conditioned not only by legal separation or de facto separation of marriage, but it can also be determined by who is to blame for the separation.
