Resumen:

Il presente saggio pone in luce il contributo del Professore Cesare Massimo Bianca sul tema dell’interesse superiore del bambino. Il principio di unicità dello stato di figlio e la ridefinizione della nozione di parentela sono stati il portato della novella al codice civile ad opera della l. del 10 ottobre 2012 n. 219, chiamata riforma Bianca. Tale Riforma ha dato, inoltre, risalto all'ascolto del minore capace di discernimento, prevedendolo in tutte le procedure e le questioni che lo riguardano. Il pensiero del Professore Cesare Massimo Bianca si concentrava sull'azione della legge, assumendo, nel suo pensiero, i diritti umani un ruolo di primaria importanza.

Abstract:

This essay highlights the contribution of Professor Cesare Massimo Bianca on the topic of the best interests of the child. The principle of uniqueness of the child status and the redefinition of the notion of kinship were the result of the novel to the civil code by the l. of 10 October 2012 n. 219, called the White reform. This Reform has also given prominence to listening to the minor capable of discernment, foreseeing him in all the procedures and issues that concern him. The thought of Professor Cesare Massimo Bianca concentrated on the action of the law, assuming in his thought, human rights a role of primary importance.
