Resumen:
L’analisi degli orientamenti giurisprudenziali consolidati in materia di assegnazione della casa familiare pone in rilievo l’esigenza di una lettura del diritto vivente che, superando i paradigmi tradizionali, individui un adeguato bilanciamento tra l’interesse del minore e le esigenze economiche della famiglia, anche alla luce delle delicate questioni generate dalla formazione di nuclei familiari successivamente alla separazione ed al divorzio.
Abstract:
The analysis of the consolidated case law on the assignment of the matrimonial home highlights the need to overcome the traditional paradigms and to find an adequate balance between the interests of the child and the economic needs of the family, also in light of the complex issues connected with the formation of new families after separation and divorce.
