The bonds that the manufacturers of gaming machines have to deposit with the different regional administrations in light of the Spanish law of security of the market unity.

Resumen:

A tenor de los expedientes instados por un fabricante de máquinas de juego ante la Secretaría de del Consejo para la Unidad de Mercado por habérsele exigido en diferentes Comunidades Autónomas la constitución de una fianza con carácter previo a obtener el registro para poder fabricar máquinas, se ha puesto de manifiesto que la normativa autonómica que exige dichas fianzas podría ser vulneradora de los principios de necesidad, proporcionalidad y eficacia nacional que propugna la Ley de garantía de la unidad de mercado. Así, el mero hecho de exigir una fianza con carácter previo a poder fabricar máquinas de juego (y no ya con carácter previo a poder explotar la actividad de juego propiamente dicho) podría considerarse un requisito de acceso al mercado que no se justifica por las razonas de protección de la seguridad y la salud pública que persiguen las diferentes normativas. Por otro lado, el hecho de requerírsele una fianza en una Comunidad Autónoma, cuando ya la ha depositado una similar en otra, podría no ser acorde con el principio de eficacia nacional que pretende el reconocimiento de la validez de requisitos exigidos en origen en otros destinos del territorio nacional.

Abstract:

In light of the administrative proceedings started by a manufacturer of gaming machines against the requirement to deposit a bond prior to produce said machines in different Spanish Autonomous Regions, it has been noted that said requirement could be not in accordance with the principles of need, proportionality and national effectiveness of the Spanish Law on Security of the Market Unity. On the one hand, just the fact of having to deposit a bond previously to produce machines (and not just prior to operate the proper gaming activity) could be considered as a requirement to enter into the market. This could again be understood as not justified by the reasons of security and public health, which the different regulations try to protect. On the other hand, the requirement to deposit a bond in an Autonomous Region considering that the manufacturer already deposited similar bonds in other regions could be not in accordance with the principle of national effectiveness, which aims to achieve that the requirements demanded in a region are recognized in other regions of the Spanish territory.
