Usucaption in the Bolivian legal system, between jurisprudential thrusts and the protection of the social function of property

Resumen:

El escrito realiza una sistematización crítica de las principales aristas y características que la usucapión ha tenido en el ordenamiento boliviano durante las últimas décadas con el objetivo de destacar sus rasgos característicos incluso presentes en la práctica. Para ello, se investigará la reciente evolución jurisprudencial y legislativa que esta institución ha tenido.

Abstract:

This paper provides a critical systematisation of the main aspects and characteristics that usucaption has had in Bolivian law over the last few decades with the aim of highlighting its characteristic features, even in practice. To this end, the recent jurisprudential and legislative evolution of this institution will be investigated.
