International Child Abduction in times of Coronavirus: an opportunity for the abducting parent?

Resumen:

La crisis sanitaria provocada por la pandemia del COVID-19 podrá tener una significativa afectación de los procedimientos en materia de sustracción internacional de menores, tanto desde el punto de vista procesal como sustantivo. Particularmente preocupante es la afectación de la pandemia en la duración de los procedimientos y en la efectividad del retorno del menor, sobre todo si se tiene en cuenta la especial incidencia que posee el transcurso del tiempo sobre los menores de edad. La pandemia también abre la puerta a nuevas interpretaciones de la excepción de no retorno por grave riesgo de peligro físico o psíquico sobre el menor. Mientras que el progenitor no sustractor se encontrará con importantes obstáculos para conseguir un retorno rápido y seguro del menor en este contexto, el progenitor sustractor podrá ver una oportunidad para justificar el no retorno del menor.

Abstract:

The sanitary crisis caused by the COVID-19 pandemic is likely to have a significant impact on international child abduction proceedings, both from the procedural and substantial perspective. Particularly worrisome is the impact of the pandemic on the duration of the proceedings and on the effectivity of the return of the child, taking into account the special effect that time has on children. The pandemic also opens the door to new interpretations to the exception of return of the child in cases of grave risk of physical or psychological damage to the child. While the left-behind parent will face important obstacles in order to achieve a fast and safe return of the child in this context, the abducting parent will see an opportunity to justify the non-return of the child.
