Resumen: En el presente trabajo se examina cuán efectiva es la subrogación arrendaticia “inter vivos” como medida de protección de la vivienda familiar y, por ende, de la familia. Para ello es obligado un estudio inicial acerca de la institución jurídica protagonista, esto es, de la vivienda familiar, gracias al cual se logra desarrollar el análisis realizado posteriormente sobre lo estipulado en los artículos 12 y 15 LAU, pudiendo concluir cuáles son los aciertos y cuáles las posibles mejoras de la legislación vigente en este ámbito.

Abstract: This paper examines how effective “inter vivos” tenancy subrogation is as a measure for the protection of the family home and, therefore, of the family. In order to do so, an initial study of the legal institution involved, i.e. the family home, is required, allowing us to develop the subsequent analysis of the provisions of articles 12 and 15 LAU, and to conclude which are the successes and which are the possible improvements of the current legislation in this field.
