Resumen:

Este trabajo hace referencia a la repercusión que los regímenes económicos matrimoniales, concretamente el régimen de sociedad legal de gananciales, pueden tener en la empresa familiar, al desempeñarse por un cónyuge una actividad empresarial. Con esta finalidad, estudiaremos el carácter ganancial, privativo o mixto de la empresa familiar, así como las ganancias o pérdidas generadas por la misma. Asimismo, examinaremos la disolución y liquidación del régimen matrimonial y la regulación de los derechos de adquisición preferente, basándonos en la adjudicación de la empresa al cónyuge empresario, cuestión fundamental para garantizar su continuidad tras la ruptura de la relación matrimonial.

Abstract:

This work refers to the repercussion that matrimonial property regimes, specifically the system of community property, can have on a family business when the business activity is performed by a spouse. To this end, we will study the marital, proprietary or mixed character of the family business as well as the profits or losses it generates. We will also examine the dissolution and liquidation of the matrimonial regime and regulation of preferential acquisition rights, based on the company being awarded to the entrepreneurial spouse, a fundamental issue to ensure its continuity after the breakdown of the marital relationship.
