The reform of Catalan law in terms of disability.

La Comisión de Codificación de Cataluña está trabajando en el encargo del Gobierno de la Generalitat de la revisión del Código Civil de Cataluña para su adaptación a la Convención de Nueva York. Los trabajos prelegislativos todavía no han finalizado y aún no ha empezado la tramitación parlamentaria de la reforma del derecho catalán en materia de discapacidad. Con todo, ya es posible avanzar cuáles son las bases que van a regir esta reforma, que se encuentran recogidas en el documento de Bases. Además, se ha aprobado el Decreto ley 19/2021, de 31 de agosto, por el que se adapta el Código Civil de Cataluña a la reforma del procedimiento de modificación judicial de la capacidad, que ha venido a salvar el vacío legal que de otro modo habría comportado la aprobación de la Ley estatal 8/2021 en el territorio catalán. Y también existen ya algunas resoluciones judiciales que aplican esta nueva normativa y sientan nuevos criterios jurisprudenciales que resultan de gran interés.
Abstract:
The Codification Commission of Catalonia is working on the commission of the Government of the Generalitat to revise the Civil Code of Catalonia for its adaptation to the New York Convention. The pre-legislative work has not yet been completed and the parliamentary processing of the reform of Catalan law on disability has not yet begun. However, it is already possible to advance what are the bases that will govern this reform, which are included in the Bases document. In addition, Decree Law 19/2021, of 31 August, which adapts the Civil Code of Catalonia to the reform of the procedure of judicial modification of capacity, which has come to bridge the legal vacuum that otherwise would have led to the approval of State Law 8/2021 in The Catalan territory. And there are also already some judicial decisions that apply this new regulation and establish new jurisprudential criteria that are of great interest.
