The (In)Adequacy of the Spanish 'Traffic Scale' in the Assessment of Dental Damage

Resumen:
El propósito de este trabajo consiste en realizar una propuesta de mejora del actual «baremo de tráfico», introducido como Anexo IV por la Ley 35/2015 y concretamente su adaptación hacia una valoración más precisa del tratamiento que dicho baremo otorga a los daños en el sistema osteoarticular y boca (códigos 02042 al 02058 de dicho baremo) y su adaptación a los producidos como consecuencia del ejercicio de la Odontología. Concretamente, este trabajo pone su foco en una propuesta «de lege ferenda» en la valoración del daño dental, dado que, en su configuración actual, el baremo de tráfico resulta insuficiente para ser aplicado en la esfera odontoestomatológica, lo que crea una indeseable inseguridad jurídica.
Abstract:
It is the aim of this paper making a proposal to improve the current “traffic scale” which was introduced as Annex IV by Law 35/2015, and its adaptation towards a more precise assessment of the treatment that the scale grants to damages in the osteoarticular system and mouth (codes 02042 to 02058 of the scale) and its adaptation to oral bodily injuries and bodily harm caused by the doctor as a consequence of the practice of Dentistry. Due the current absence of a specific scale for damages caused by healthcare activities, provided for in Additional Provision 3 of Law 35/2015, the “traffic scale” introduced as Annex IV by said law is continuously used analogically; used in forensic practice to quantify oral damage. However, the assessment of the damage caused as a consequence of the dentist’s activity, in certain cases, cannot be carried out correctly due to the inadequacy of the instrument generally used for these cases. Specifically, this work focuses on a “de lege ferenda” proposal in the assessment of dental damage, given that, in its current configuration, the traffic scale is insufficient to be applied in the oral sphere, which creates undesirable legal uncertainty.
