Resumen:

El Derecho de Familia constituyó uno de los importantes temas de estudio del profesor Cesare Massimo Bianca, por ello en homenaje a su obra se dedica la investigación de la guarda y custodia compartida, tema de gran sensibilidad en la cual está presente el interés superior de la niñez y a la que el profesor le dedicó un análisis de suma importancia. El artículo elaborado en esta ocasión se fundamenta en la experiencia y realidad jurídica mexicana en la que esta institución comienza a afianzarse desde la perspectiva jurisprudencial más que legislativa, aunque empieza a estar presente, pero de forma débil en las leyes mexicanas.

Abstract:

Family Law was one of the important topics of study of Professor Cesare Massimo Bianca, for this reason, in homage to his work, the investigation of joint custody and custody is dedicated, a subject of great sensitivity in which the best interests of the community are present. childhood and to which the teacher dedicated an analysis of the utmost importance. The article prepared on this occasion is based on the Mexican legal experience and reality in which this institution begins to take hold from a jurisprudential rather than a legislative perspective, although it is beginning to be present, but weakly, in Mexican laws.
