La gestación por sustitución en España: algunas “novedades”.

Resumen:

La gestación por sustitución en España es un tema controvertido y de actualidad. Por ello en el presente trabajo hemos considerado oportuno recoger y comentar sucintamente algunas “novedades” que hablan de este tipo de gestación bien para reprobarla, bien para apoyarla. En este sentido, tenemos en cuenta, por una parte, el Informe del Comité de Bioética de España de mayo de 2017 y la Proposición de Ley llevada al Congreso por parte del Grupo Parlamentario Ciudadanos admitida a trámite en septiembre de este año, sin perjuicio y por la cercanía, nos referimos también a la ley portuguesa sobre gestación por sustitución aprobada recientemente.

Abstract:

Gestation by substitution in Spain is a current and controversial issue. Therefore, in this work, we have considered it opportune to succinctly collect and comment some “novelties” that contemplate this type of gestation, either to reprove it or to support it. In this regard, we must refer, on one hand, the Report of the Bioethics Committee of Spain, from May 2017, and the Proposed Law submitted to Congress by the “Ciudadanos” Parliamentary Group admitted in transit in September of this year, without prejudice and by the proximity, we also refer to the Portuguese law on gestation by substitution recently approved.
