La gestación por sustitución a partir de los nuevos criterios judiciales en México

Resumen:

El sistema jurídico mexicano está conformado por 32 Códigos Civiles y aproximadamente once leyes familiares, pero no todas se detienen en el tema de la Gestación por sustitución, aunque la Suprema Corte de Justicia de la Nación ha ido sentando pautas para resolver situaciones ocurridas en Estados donde no existe legislación al respecto. Pero uno de los Estados donde sí está regulada y a partir del año 2016 se produjeron hechos que implicaban trata de niños ha sido Tabasco, por eso, - a su manera- el Gobierno en turno dictó un Decreto que trataba de frenar el comercio de las criaturas. Lo cierto es, que desde su incorporación al Código Civil no ha existido un orden preestablecido y ello ha provocado muchos problemas. Lo anterior provocó la reforma que se dio a partir del Decreto 265/2016 que a su vez provocó varios amparos, destacando en este trabajo, la acción de inconstitucionalidad 16/2016.

Abstract:

The Mexican legal system is made up of 32 Civil Codes and eleven family laws, but not all of them treat the issue of surrogate gestation although the Mexican Supreme Court of Justice has established guidelines to resolve situations that occur in some states lacking legislation on the matter. Tabasco is one of the few states that regulate this issue since 2016, but they also suffer events regarding child trafficking. For this reason, the Government, in turn, issued a Decree trying to stop child trade. The truth is that since its incorporation into the Civil Code there has not been a pre-established order and this has caused many problems. The foregoing caused the reform that was given from Decree 265/2016, which in turn caused several protections, highlighting in this work, the action of unconstitutionality 16/2016.
