The intentional filiation in cases of double motherhood.

Resumen:

La doble maternidad viene reconocida en el art. 7.3 LTRHA, dando valor al consentimiento de la mujer casada con otra, siempre que no esté separada, para manifestar conforme a lo dispuesto en la Ley del Registro Civil que se determine a su favor la filiación respecto al hijo nacido de su cónyuge. La Ley 4/2023, de 28 de febrero, para la igualdad real y efectiva de las personas trans y para la garantía de los derechos de las personas LGTBI ha reformado el art. 44 LRC y en concreto, el nuevo apdo. 4 hace referencia a la inscripción del nacimiento de los hijos de parejas de dos mujeres, reconociendo tanto la filiación matrimonial, pudiendo estar separadas, como no matrimonial, sin reformar el art. 7.3 LTRHA. Así, se puede estar ante un nuevo tipo de filiación legal, conocida como “filiación intencional”, al ser el consentimiento un nuevo título de determinación de la filiación, sin olvidarnos de la importancia del interés superior del menor.

Abstract:

Double motherhood is recognized in art. 7.3 LTRHA, giving value to the consent of the woman married to another, if she is not separated, to express in accordance with the provisions of the Civil Registry Law that the filiation with respect to the child born to her spouse is determined in her favor. Law 4/2023, of February 28, for the real and effective equality of trans people and for the guarantee of the rights of LGTBI people has reformed art. 44 LRC and specifically, the new section 4 refers to the registration of the birth of children born to couples of two women, recognizing both marital affiliation, which may be separated, and non-marital affiliation, without reforming art. 7.3 LTRHA. Thus, we may be faced with a new type of legal filiation, known as intentional filiation, as consent is a new title for determining filiation, without forgetting the importance of the best interests of the minor.
