La extinción de la pensión compensatoria por “convivencia marital”: significado y finalidad.

Abstract:

This paper analyses the compensatory allowance, specifically the extintion because of “cohabitate with another person”. Thereby, it sets out the different interpretations and, finally, the choice of The Supreme Court. Furthermore, it explains if its function is coherent with the actual interpretation. However, that reasoning may call into question the existence of the compensatory allowance in our actual society.

Resumen:

La presente comunicación analiza el aspecto extintivo de la pensión compensatoria, concretamente su extinción por “vivir maritalmente con otra persona”. De esta forma, pone de relieve las distintas interpretaciones a las que ha dado lugar la expresión y, finalmente, cuál ha sido la postura del Tribunal Supremo. Asimismo, plantea si su supuesto fundamento resulta coherente con la solución escogida por el Supremo. No obstante, ese razonamiento nos puede llevar al cuestionamiento mismo de la finalidad de la pensión compensatoria en la sociedad actual.
