Effectiveness of transfer agreement of the right to claim authorship.

Resumen:

La autoría fantasma constituye un fenómeno en virtud del cual el verdadero creador de una obra trasmite a otro sujeto los derechos morales (en especial, el derecho de paternidad) y los derechos de explotación que tiene sobre la misma, comprometiéndose además a no revelar su identidad como auténtico autor de la obra. En este trabajo se analizará la figura del autor fantasma, las obligaciones que se generarán como consecuencia del acuerdo suscrito entre ambas partes y la posible eficacia de dicho contrato.

Abstract:

The ghost authorship could be described as the case in which the authentic author transfers to another person their authorship moral rights (it included the right to claim authorship) and copyrights ones. Also, he or she agrees not to reveal their identity as the authentic author. In this work, I analyze the ghost author figure, those obligations that could be claimed as result of the agreement and the effectiveness of an agreement of this sort.
