Parental coordination in situations of high family conflictivity: More than a judicial Measure?

Resumen:

En ocasiones, los casos de divorcio o separación conllevan una alta conflictividad, lo que repercute negativamente en el desarrollo psicosocial de los hijos. Frente a estas situaciones altamente conflictivas, y con el objetivo principal de proteger el interés superior de los menores implicados, ha irrumpido en los últimos años en España la figura del Coordinador Parental, como medida aprobada por los jueces en ejecución de sentencia (vía judicial). A falta de regulación, se ha venido planteando la duda de si se trata de un mediador familiar, y por tanto, su régimen jurídico puede circunscribirse a la Ley 5/2012, de 6 de julio, de mediación. No obstante, existen diferencias notables entre ambas figuras, lo que puede sugerir la necesidad de regular el estatuto del Coordinador Parental.

Abstract:

Sometimes, cases of divorce or separation entail high conflict, which has a negative impact on the psychosocial development of children. Faced with these highly conflictive situations, and with the main objective of protecting the best interests of the minors involved, the figure of the Parental Coordinator has emerged in Spain in recent years, as a measure approved by the judges in execution of the sentence (judicial means). In the absence of regulation, the question has been raised as to whether it is a family mediator, and therefore, its legal regime can be limited to Law 5/2012, of July 6, on mediation. However, there are notable differences between both figures, which may suggest the need to regulate the status of the Parental Coordinator.
