Marital coexistence as a cause for termination of the right to attribute the use of the family home.

La convivencia marital como causa de extinción del derecho de atribución del uso de la vivienda familiar.

Resumen:

La convivencia de un tercero en la vivienda familiar atribuida a uno de los cónyuges no se contempla en el Código Civil español como causa de extinción del uso de dicha vivienda. No obstante, a raíz de la Sentencia núm. 641/2018, de 20 noviembre, se reconoce dicha causa de extinción, si bien existen muchos intereses a proteger, entre los cuales se encuen-tran el interés superior del menor, y, por otro lado, la libertad del cónyuge que podría que-dar comprometida. Por otro lado, el cónyuge no atribuido, frecuentemente no custodio y propietario o copropietario de la vivienda, ve que tiene que seguir sufragando las cuotas del préstamo u otros gastos mientras que el tercero incluso está lucrándose del precio del alquiler de su propia vivienda, al no necesitarla.

Abstract:

The coexistence of a third party in the family home attributed to one of the spouses is not contemplated in the Spanish Civil Code as a cause for termination of the use of said home. However, as a result of Judgment no. 641/2018, of November 20, this cause of extinction is recognized, there are many interests to protect, among which are the best interests of the minor, and, on the other hand, the freedom of the spouse that could be compromised. On the other hand, the non-attributed spouse, often a non-custodian and owner or co-owner of the home, sees that they have to continue paying the loan installments or other expens-es, while the third is even profiting from the rental price of his own home, by not needing it.
