Resumen:

Il saggio analizza il principio di buona fede nella sua evoluzione normativa e giurisprudenziale. Attraverso l’approfondimento dottrinario del dato normativo e le pronunce giurisprudenziali sul tema, l’indagine si sofferma sull’origine etica del concetto di buona fede, sulle diverse accezioni nel codice civile (buona fede in senso oggettivo e in senso soggettivo), sul contenuto del principio in materia contrattuale ed in altri settori del diritto come la famiglia, la tutela giudiziale dei diritti, la privacy e l’intermediazione finanziaria.

Abstract:

The essay analyzes the principle of good faith in its normative and jurisprudential evolution. Through an in-depth study of the normative data and the jurisprudential pronouncements on the subject, the investigation focuses on the ethical origin of the concept of good faith, on the different meanings in the civil code (good faith in an objective and subjective sense), on the content of the principle in contractual matters and in other areas of law such as the family, the judicial protection of rights, privacy and financial intermediation.
