The autonomy of the will in the field of family law.

Resumen:

El principio de autonomía de la voluntad es de gran aplicación en las relaciones patrimoniales, sin embargo, ha estado excluido del Derecho de Familia, situación que se ve cuestionada por el impacto de los Tratados Internacionales sobre Derechos Humanos, que consagran los principios de igualdad y libertad de los ciudadanos sin excepciones, lo que trae como consecuencia un ámbito de mayor libertad para regular los efectos de las relaciones familiares. Dicha situación se puede apreciar por la progresiva incorporación de acuerdos sobre distintas materias de familia, especialmente en situación de crisis familiar. No obstante que la actual legislación de familia permite celebrar estos acuerdos, su regulación es escueta y la posible existencia de vacíos legales nos obliga a analizar la posible aplicación de la teoría del acto jurídico patrimonial en el ámbito familiar.

Abstract:

The principle of autonomy of the will is highly applicable in Law of Property, however, it has been excluded from Family Law, a situation that is questioned by the impact of International Treaties on Human Rights, which enshrine the principles of equality and freedom of citizens without exceptions, which brings consequently an area of ​​greater freedom to regulate the effects of family relationships. This situation can be appreciated by the progressive incorporation of agreements on different family matters, especially in situations of family crisis. Despite the fact that current family legislation allows these agreements to be entered into, their regulation is brief and the possible existence of legal loopholes forces us to analyze the possible application of the theory of the legal act of property in the family sphere.
