Resumen:
Tras exponer las líneas generales de la ley que regula la atribución del uso de la vivienda familiar en la Comunidad Valenciana, se dedica este trabajo a poner en relación la atribución de dicho uso y el Registro de la Propiedad. Se examinan en concreto: el documento que se presenta a inscripción, el tipo de asiento que deberá practicar el registrador, el contenido del mismo, la posición jurídica de la persona a cuyo favor se inscribe el uso y los distintos supuestos que se pueden dar, dependiendo de cómo esté inscrita la finca y de qué actos accedan al Registro después de la inscripción del uso. A lo largo de todo el trabajo, porque tiene relación con los aspectos analizados, y de forma directa en el último capítulo, se aborda la naturaleza jurídica del uso de la vivienda familiar.
Abstract:
After presenting the outlines of the law governing the allocation of sole use and occupancy of the former matrimonial home in Valencia, this work is dedicated to offer a legal explanation regarding the relationship between the attribution of such use and occupancy and the Land Registry. In particular, the author examines the document submitted for registration, the type of assent that should be applied by the registrar and the content thereof, the legal position of the person in whose favor the use and occupancy is registered, and the different assumptions that could be foreseen, as it will depend on how the property was originally registered, and which kind of acts should have access the Registry after the assent of sole use and occupancy. The last part of this work is dedicated to addressing some other legal issues such as the nature of the family home as it is closely related with all the questions previously analyzed.
