THE ACQUISITION OF THE FAMILY HOME UNDER THE COMMUNITY OF PROPERTY REGIME.

Resumen:

RESUMEN: Se aborda en este estudio la fijación del carácter privativo, ganancial o mixto de la vivienda familiar adquirida antes del comienzo de la sociedad de gananciales o durante su vigencia. Se analizan, a este respecto, aplicados a la vivienda familiar, los distintos criterios legales de determinación del carácter ganancial o privativo de los bienes: el llamado principio de subrogación real, las adquisiciones mixtas, la “accesión económica”, el criterio del carácter del propio bien o derecho del que deriva el derecho a la adquisición o la regla de la accesión aplicable a la edificación realizada por uno o ambos cónyuges en un solar privativo o ganancial; todos ellos en su relación con la presunción de ganancialidad. Dada la relevancia que adquiere la autonomía de la voluntad de los cónyuges en la determinación de la condición de los bienes del matrimonio, se incluye un tratamiento de los negocios jurídicos que permiten un cambio de naturaleza de la vivienda familiar: de ganancial a privativa de un cónyuge o viceversa.

Abstract:

ABSTRACT: This study deals with the determination of the private, community or mixed character of the family home acquired before the beginning of the community of property or during its validity. In this respect, the different legal criteria for determining whether the property is a community property or a separate property are analysed, applied to the family home: the so-called principle of real subrogation, mixed acquisitions, “economic accession”, the criterion of the nature of the property or right from which the right to the acquisition derives or the rule of accession applicable to the building carried out by one or both spouses on a private or community property plot; all of them concerning the presumption of community property. Given the relevance acquired by the spouses’ autonomy of will in determining the status of the marital property, a treatment is included of the legal transactions that allow a change in the nature of the family home: from community of property to private property of one spouse or vice versa.
