Best interest of the child: the figure of grandparents in the foster care system.

Resumen:

Il presente saggio pone l’attenzione sulla valorizzazione della figura dei nonni nell’affido temporaneo, da parte del giudice del merito. Tale valorizzazione risponde all’interesse superiore del minore: affidare il bambino, già allontanato dai suoi genitori biologici, ai nonni significa evitargli lo sdraticamento dal contesto familiare in cui è cresciuto. In materia di affidamento familiare, è fondamentale non allentare il legame che il minore ha con il nucleo familiare d’origine, in quanto tale istituto, superate le situazioni temporanee di difficoltà dei genitori per le quali viene disposto, prevede il rientro dello stesso minore nella sua famiglia d’origine.

Abstract:

This essay focuses on the enhancement of the figure of grandparents, in temporary custody, by the judge of merit. This enhancement responds to the best interests of the child: entrusting the child, already estranged from his biological parents, to the grandparents, means avoiding him from becoming relaxed from the family context in which he grew up. In the matter of family custody, it is essential not to loosen the bond that the minor has with the family unit of origin, as this institution, once the temporary situations of difficulty of the parents for which it is ordered are overcome, provides for the return of the same minor to his family of origin.
