Resumen:

En los juicios de reconocimiento de paternidad, se ha considerado la prueba genética como aquella que permite acreditar la filiación para establecer el nexo biológico, sin embargo, esta posición ha evolucionado frente al interés superior de la niñez y el derecho a la identidad, toda vez que además es posible reconocer la filiación conforme a la realidad social en que se encuentra el infante, esta situación es analizada en este texto, acorde a la forma de solución judicial que se ha dado en México a partir de un estudio de casos.

Abstract:

In the paternity recognition trials, the genetic test has been considered as that which allows accrediting the affiliation to establish the biological link, however, this position has evolved against the best interests of childhood and the right to identity, all the time that it is also possible to recognize the affiliation according to the social reality in which the infant is, this situation is analyzed in this text, according to the form of judicial solution that has been given in Mexico from a case study.
