Resumen:

Cuando una pareja con hijos comunes menores de edad deja de convivir surge la necesidad de determinar las reglas o normas por las que se regirá la nueva situación familiar. Estas normas pueden ser de carácter económico o personal. Entre las personales, y una sobre las que más les cuesta decidir a los progenitores, es la relativa al cuidado de los hijos y a cómo se va a dar continuidad a las relaciones con ellos una vez se haya producido la separación. Lo mejor sería que los propios progenitores pudieran llegar a un acuerdo al respecto ya que ellos son los que mejor conocen a sus hijos y los mejores conocedores de la situación que están viniendo. Pero en defecto de acuerdo será necesario determinar si es necesario que el Juez adopte alguna de las medidas solicitadas por los progenitores o, por el contrario, podrá adoptar la medida que considere mejor salvaguarda el interés superior de los menores.

Abstract:

When a couple with common children under age stop living together, there is a need to determine the rules or norms by which the new family situation will be governed. These rules can be of an economic or personal nature. Among the personal ones, and one on which parents find it most difficult to decide, it is relative to the care of the children and how they are going to give continuity to the relations with them once the separation has taken place. The best thing would be that the parents could reach an agreement in this regard since they are the ones who better know their children and the best connoisseurs of the situation. But in the absence of an agreement it will be necessary to determine if it is necessary for the Judge to adopt any of the measures requested by the parents or, on the contrary, may adopt the measure that it considers best safeguards the interests of the minors.
