El presente trabajo aborda las funciones que el principio del interés de los niños, niñas y adolescentes cumple en el sistema chileno de protección del consumidor. Se le reconoce en primer lugar su carácter de principio general del derecho, y como tal se le atribuye una aptitud polifuncional, por la cual cumple diversos roles en el sistema de fuentes del Derecho de Consumo. Se enuncia así su función interpretativa, que exige que toda exégesis normativa debe encaminarse hacia el resguardo del interés de los niños y adolescentes. De la misma manera sirve de mecanismo de integración normativa y de resolución de antinomias jurídicas. En tal contexto permite establecer estándares de cumplimiento de los deberes, a través de la delimitación de la prestación social esperable. Finalmente tiene un carácter político, por el cual inspira la disciplina conductual.

Abstract:

The paper refers to the functions that the principle of the interest of children and adolescents fulfills in the Chilean Consumer Protection System. At first, its character as a General Principle of Law is recognized, and it is attributed a polyfunctional aptitude, for which is fulfills different roles in the Consumer Law. Its interpretive function is thus stated, which requires that all normative exegesis must be directed towards safeguarding the interest of children and adolescents. In the same way, it serves as a mechanism integration and resolution of legal contradictions. In such context, it allows establishing standards of duties, through the delimitation of the expected social Benefit. Finally it has a political character, by which it inspires behavioral discipline.
