La de las familias reconstituidas es una realidad definida por la existencia de hijos o hijas involucrados en una nueva configuración familiar, a la que llegan acompañando al padre o madre que ejerce su cuidado, que propiciará relaciones cotidianas y afectivas en que el nuevo/a cónyuge o pareja del padre o madre podrá asumir funciones parentales significativas para su desarrollo. Contexto en que resulta relevante analizar el eventual vínculo jurídico entre ese adulto y el niño, niña o adolescente, materia que viene siendo abordada desde los ordenamientos jurídicos mayormente al margen de una normativa específica, surgiendo el imperativo de contar con reglas que guarden coherencia con el debido resguardo a los derechos de infancia y adolescencia, pudiendo incluso encaminar adecuaciones normativas con objeto de incorporar los diversos matices que esa relación pudiere revestir.

Abstract:

Stepfamilies are a reality defined by the existence of son or daughters involved in a new family configuration, to which they arrive accompanying the father or mother who exercises their care, which will foster daily and affective relationships in which the new spouse or partner of the father or mother will be able to assume significant parental functions for their development. Context in which it is relevant to analyze the eventual legal link between that adult and the child or adolescent, a matter that has been addressed from legal systems mostly outside of specific regulations, arising the imperative to have rules that are consistent with due protection of the rights of childhood and adolescence, and may even direct a normative adaptation in order to incorporate the various nuances that this relationship may have.
