Resumen:
O presente escrito trata a evolução da regulação das “insurance warranties” no Direito inglês, perante o pano de fundo da recente substituição do seu regime tradicional, constante do Marine Insurance Act, por um novo regime constante do Insurance Act de 2015. Dá-se conta das críticas ao carácter draconiano e à falta de transparência do anterior regime e expõe-se os principais traços caracterizadores do novo regime, com especial destaque para a introdução de testes de conexão do risco.
Abstract:
This article handles the evolution of the English law of insurance warranties, against the background of the recent replacement of the traditional regulation, as set out on the Marine Insurance Act, for a new set of rules foreseen on Insurance Act of 2015. It gives notice of the criticism aimed at the draconian character and lack of transparency of the former regime and presents the main features of the new regulation, with a special focus on the introduction of risk increase requirements.
