The use of the image of the minor student in the educational centers (special attention to the use of the social networks)

Resumen:

En el presente estudio se analiza el uso de la imagen de estudiante menor de edad por un centro escolar especialmente en las redes sociales. Se analiza si la libertad de educación y la libertad de información pueden justificar el uso de la imagen del menor sin necesidad de recabar consentimiento alguno. También se analiza el uso de la imagen del estudiante por parte del centro escolar con el consentimiento de los menores de edad o el de los representantes legales, así como la intervención del Ministerio Fiscal.

Summary:

In the present study we analyze the use of the image of underage student by a school especially in the social networks. It is analyzed whether freedom of education and freedom of information can justify the use of the image of the child without the need to obtain consent. It also analyzes the use of the student’s image by the school with the consent of the minors or that of the legal representatives, as well as the intervention of the Fiscal Ministry.
