The European Regulation of Succession and the Plurilegislative Character of the Spanish Civil System

Resumen:
En el presente trabajo se realiza una exposición general de los nuevos criterios establecidos por el Reglamento (UE) n.º 650/2012 del Parlamento Europeo y del Consejo, de 4 de julio de 2012, en materia de ley aplicable a las sucesiones por causa de muerte con alcance transfronterizo. Pero su objetivo fundamental se cifra, ante todo, en determinar cómo han de aplicarse estos en el singular caso del Estado español atendido el carácter plurilegislativo de su ordenamiento civil y el régimen previsto para los ordenamientos de esta clase en los artículos 36 a 38 del Reglamento.
Abstract:
It is done in this paper a general exposition of the new criteria established by Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012, on the law applicable to succession takes place upon death with cross-border implications. But its main aim is determine how to apply these in the singular case of the Spanish State, attended the plurilegislation character of its civil system and the regime provided for systems of this kind in the articles 36-38 of the Regulation.
