The new legal treatment of pet animals in divorces.

Resumen:
En 2017 se presenta una proposición de ley sobre el régimen jurídico de los animales. Plantea que el Código Civil español los considere seres vivos dotados de sensibilidad en vez de bienes muebles. Este nuevo tratamiento jurídico de los animales de compañía obliga al juez, en las crisis matrimoniales, a pronunciarse sobre su guarda y custodia, visitas y gastos, valorando, para ello, el interés de los miembros de la familia y bienestar del animal.
Abstract:
In 2017 a proposed law on the legal status of animals is presented. Proposes that the Spanish Civil Code consider living beings endowed with sensitivity instead of movable property. This new legal treatment of pets requires the judge, in marital crises, to decide on their custody, visits and expenses, valuing, for this, the interest of family members and the welfare of the animal.
