Resumen:
En el presente trabajo se analiza la situación actual en que se encuentra, en España, el derecho al olvido digital, y la configuración que le ha dado la Agencia Española de Protección de Datos y el Tribunal de Justicia de la Unión Europea. También se expone el marco normativo en que se podría encuadrar el derecho al olvido, tanto a nivel nacional como europeo, haciendo especial hincapié en la propuesta de Reglamento General de Protección de Datos, puesto que reconoce expresamente el derecho al olvido. Finalmente, se analiza la principal problemática que se plantea en relación con este derecho, junto con sus posibles soluciones, centrándome en los ámbitos relacionados con los motores de búsqueda y las redes sociales.
Abstract:
In this paper is analyzed the current situation that is, in Spain, the right to digital oblivion, and its configuration that has been given by the Spanish Data Protection Agency and the European Court of Justice. It is also exposed the regulatory framework in that could frame the right to be forgotten, both at national and European level, with particular emphasis on the proposed General Data Protection Regulation, as expressly recognizes the right to oblivion. Finally, is analyzed the main problem that arises in relation to this right, and their possible solutions, focusing on areas related to search engines and social networks.
