Resumen:
En los últimos años el tema de las sanciones administrativas se encuentra en el centro del debate doctrinal y jurisprudencial italiano; en él ocupan un papel central las sanciones de las autoridades administrativas independientes, entre las que se halla la Comisión Nacional de las Sociedades Mercantiles y la Bolsa (CONSOB, por sus siglas en italiano), que es el objeto de este estudio. Tras haber esbozado un cuadro general del sistema de la justicia administrativa en Italia, el análisis propuesto se centra especialmente en la tutela del juez italiano frente a las sanciones de la CONSOB, comprobando si las soluciones actuales del legislador nacional consiguen garantizar unos estándares de efectividad y suficiencia de dicha tutela, tal y como exigen la Constitución y el derecho comunitario europeo.

Abstract:
In recent years, the topic of the administrative penalties is at the heart of the Italian doctrinal and jurisprudential debate. In this debate, the penalties of the Independent Administrative Authorities have assumed a central role; CONSOB is one of these Authorities and her penalties are the specific topic of this study. First of all, this work describes a general framework of the Italian system of administrative justice; then, it analyzes the protection of the Italian judge against CONSOB penalties, checking if the current solutions of the Italian legislator are able to ensure the standards of effectiveness and fullness that the Italian Constitution and the European right need.
