Resumen:

En este trabajo se analiza la posición del conviviente supérstite en la sucesión mortis causa en el Código civil y en los derechos forales, con el fin de valorar su adecuación a la realidad social y jurídica. Se concluye con dos propuestas de reforma del Código civil cuyo contenido respeta los límites constitucionales del art. 32.

Abstract:

This paper analyzes the position of the surviving cohabitant in the mortis causa succession in both Civil Code and autonomic laws, in order to assess its adequacy to the social and legal reality. It concludes with two proposals for the reform of the Civil Code whose content respects the constitutional limits of art. 32.
