Este estudio se centra en la modificación operada por la Ley 8/2021 en cuanto a los derechos de visita, comunicación y compañía del progenitor no custodio respecto de sus hijos, principalmente en lo relativo a la limitación o suspensión de los mismos. Se busca confeccionar un comentario crítico de esta, identificar aquellos aspectos que hayan resaltado en mayor medida y, acudiendo a las opiniones jurisprudenciales y doctrinales reinantes hasta que se materializó dicha reforma, cavilar acerca de si se alinea o no con las corrientes de pensamiento que le preceden y, en definitiva, concluir si las novedades introducidas son un medio acertado para lograr los objetivos que parecieran impulsarlas.
Abstract:
This study focuses on the modification made by Law 8/2021 regarding the rights of access, communication and company of the non-custodial parent with respect to his or her children, mainly in relation to the limitation or suspension of these rights. The aim is to make a critical commentary on this, to identify those aspects that have stood out to a greater extent and, by turning to the prevailing jurisprudential and doctrinal opinions until the reform was implemented, to consider whether or not it is in line with the currents of thought that preceded it and, in short, to conclude whether the novelties introduced are the right way to achieve the objectives that seem to have driven them.
