Resumen:

Dopo aver affrontato i rapporti fra arte e diritto nella Costituzione repubblicana italiana del 1948, il saggio affronta il tema del c.d. diritto di autentica delle opere d’arte e dell’ammissibilità dell’accertamento giudiziale della loro autenticità, negata con fermezza dalla giurisprudenza delle Corti italiane.

Abstract:

After dealing with the relationship between art and law in the Italian law system (particularly in the Italian Constitution of 1948), the essay deals with the theme of the so-called right to authenticate works of art and the admissibility of judicial assessment of their authenticity, firmly denied by the jurisprudence of the Italian Court.
